Abstract |
Background. The problem of gender equality and equal legal status of men and women existed throughout the entire development of the statehood in Russia. It still exists today. In Russia, from the onset of the statehood and until the October Revolution, gender equality was not practically covered in legislative acts. The woman did not take part in public life. The only function that she performed was related to family relations: reproduction of the family, management of the household. The objective of the study is to study and analyze the history of changes in the legal status of women at all times. Materials and methods. The objective of the study is achieved on the basis of general scientific, interdisciplinary and specific scientific methods, which allowed to fully reveal the historical and theoretical foundations of equal rights of men and women in Russia. In addition, the historical, structural functional, statistical and comparative legal methods are used in the course of the study. Results. The formation of the legal status of women is explored from the onset of the statehood and until the emergence of the USSR. The study gives a historical insight into the role of women in public life: their main functions, rights and duties. It examines the degree of responsibility of the male population for using physical force against women, as well as for committing their murders. The stage of the appearance of partial equality of rights of men and women is investigated. Conclusions. The patriarchal society did not recognize the equality of rights and freedoms of men and women. It was based on the idea of male dominance. In the course of the study, a constant imbalance in the regulation of gender equality is visible, a constant infringement of rights of the female population is noticeable. At present, the situation has not changed – the old ideas about the role of women still prevail in the society. |
